Terms of Service

Welcome to Snowpery. These Terms of Service ("Terms") govern your use of the Snowpery mobile application and website (collectively, the "Service") operated by Horvault Limited ("Company", "we", "us", or "our"), a company incorporated in Hong Kong.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use Snowpery. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

2. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update it as needed.

3. User Content

You retain ownership of all content you upload, including videos, photos, and text ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free licence to process, store, and display your content solely to provide the Service. We will not use your content for advertising or sell it to third parties.

4. AI Video Processing

Snowpery uses artificial intelligence to analyse and edit your video footage. AI-generated highlights are created from your original content and belong to you. We do not claim ownership of AI-processed outputs. Processing occurs on our secure servers and original footage is not retained after processing is complete unless you choose to store it.

5. Subscriptions and Payments

Some features require a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store. You may cancel at any time through your app store settings. Refunds are subject to the policies of the respective app store.

6. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) upload content that infringes intellectual property rights; (c) harass, abuse, or harm other users; (d) attempt to reverse-engineer or extract source code from the Service; (e) use automated systems to access the Service without permission; or (f) upload malicious content including viruses or malware.

7. GPS and Location Data

Snowpery collects GPS data during sessions for performance tracking and trail mapping. This data is processed locally on your device when offline and synced to our servers when connectivity is available. You can disable GPS tracking at any time in the app settings. Location data usage is further described in our Privacy Policy.

8. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Horvault Limited and protected by intellectual property laws. "Snowpery" and the Snowpery logo are trademarks of Horvault Limited. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. Weather forecasts, avalanche reports, and snow conditions are provided for informational purposes only and should not be your sole basis for safety decisions. Always follow local safety guidelines and check official sources before heading to the mountain.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Horvault Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to personal injury, property damage, or data loss.

11. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms. You may delete your account at any time from the app settings. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
